How Professional Ethics Win More Listings: The GIPE Standard Explained

In a country where real estate agency is still unregulated in most regions, ethical practice is not a compliance obligation, it is the sharpest competitive advantage an agent can hold.
Spain’s property market is the largest in southern Europe by transaction volume. And yet the profession that facilitates most of those transactions remains legally unregulated in the majority of the country. Anyone can call themselves an estate agent, collect a commission, and face no professional body, no disciplinary mechanism, and no mandatory insurance.
This is not a minor administrative gap. It is the structural condition that defines the entire professional landscapem, and the reason why ethical positioning is such a powerful commercial tool.

Ethics as a Captación Tool, Not a Compliance Box
Most agents think of professional ethics as something that governs behaviour after the mandate is signed. But the more commercially significant application of ethics is at the point of captación — before the mandate exists.
A seller evaluating agents is conducting a trust assessment: will this person handle my asset responsibly? Will they tell me the truth about pricing even when it’s not what I want to hear? Will there be someone to turn to if something goes wrong? Every element of ethical positioning that an agent makes visible during the listing appointment is a direct answer to those questions.
What the Law Now Requires
Spain’s Ley de Vivienda 12/2023, in force since May 2023, introduced mandatory transparency obligations for all real estate professionals. These are not suggestions — violations can result in fines of up to €1 million for very serious cases. In 2024 and 2025, Spain’s Ministry of Consumer Affairs opened formal investigations and sanctioning procedures against several major nationwide agencies for prohibited practices.

Captación doesn’t happen only at the listing appointment. It happens continuously, in how a market perceives an agent over time. Notaries, gestorías, and local lawyers know which agents prepare their clients properly , and those reputations compound.
