HOUSING LEASES:
NOW ONE-STOP LEASE REGISTRY
As recorded in the minutes of the last GIPE General Assembly held on June 6, 2025, attorney Mr. José Manuel Gómez Robles presented the most important points regarding the new Single Lease Registry and the Digital One-Stop Shop created by Royal Decree 1312/2024, which will come into effect on July 1, 2025. We are sending you the following:
Types of rentals
- Short-term rentals:
– Includes both tourist and non-tourist rentals.
– Covers rooms and entire homes.
– Requires mandatory registration if marketed through online platforms.
- Long-term rentals:
– Governed by the Urban Lease Law (LAU).
– Minimum duration of 5 years (natural person) or 7 years (legal entity).
– Voluntary registration in the Registry.
- Temporary rental:
– Requires objective justification (work, studies, medical treatment).
– Considered a use other than habitual residence under the LAU.
– Registration is not required if not marketed on platforms.
- Room-based rental:
– With shared use of common spaces (bathroom, kitchen, etc.).
– Also regulated by the aforementioned modalities.
- Tourist-use housing (VUT):
– Excluded from the LAU..
– Regulated by regional or local regulations.
– Registration is required if advertised on platforms.
Single Rental Registry
- Applicable only to short-term rentals (tourist or non-tourist) advertised on digital platforms.
- Registration is done through a Digital One-Stop Shop, managed by the Association of Registrars.
- Each accommodation unit must have its own registration number, which must be displayed on the platform.
- Registration is mandatory for both individuals and professionals.
Registry Officers
- Intermediaries/Platforms: Primary responsibility for registration if they advertise the listing.
- Owners: Subsidiarily responsible if this requirement is not met.
- Private hosts: they must register if they advertise directly on platforms.
Registration Requirements
Each application must include:
- Address and registration details of the property.
- Type and use of accommodation (temporary, tourist, etc.).
- Maximum capacity.
- Authorization (license/authorization) according to local regulations.
- Lessor details (natural or legal person).
- Selection of the rental category:
- Short-term non-tourist.
- Short-term tourist.
- Accommodation on boats.
Periodic Obligations
Annual report with:
- Anonymized list of rentals.
- Stated purpose of the rental.
- Possible requirement for additional documentation.
Penalties and Prohibitions
- Listing accommodations on platforms without a registration number is prohibited.
- Using a number associated with a category other than that of the advertised rental is prohibited.
Voluntary Registration
- For long-term rentals in accordance with the LAU (Art. 2), a registration number may be voluntarily requested.
