Chapter III: Real Estate Intermediation in the Residential Market

This chapter regulates the activity of Specialized Real Estate Agents in the Residential Sector of Andalusia, highlighting their role in intermediation, advice and management in operations related to residential properties.

Definition and Registration of Real Estate Agents

They are persons or entities that carry out paid intermediation activities in the sales, rental, exchange, transfer or management of rights of use and enjoyment of housing in Andalusia.

Registration in a specific registry, created by the Ministry of Housing, is mandatory and public, promoting transparency, professionalization and consumer protection.

Rights and Obligations

Agents must respect the rights of the people involved in the transactions and comply with the duty of information, in accordance with state and regional regulations.

Registration Requirements

• Professional training: university degree, specific training (200 hours) or experience of at least 4 years.
• Establishment open to the public (in person or online).
• Legal guarantees: civil liability insurance and guarantees to cover damages or amounts handled.
• Absence of criminal records related to real estate activity.
  

Mandatory Declarative Registration and Distinctive

Registration is done through a responsible declaration that certifies compliance with the requirements.

Agents must display the registration badge in their premises and advertising.

Nature of the Registry

The registry is administrative, free of charge and is aimed at coordinating public and public-private initiatives, especially in the area of ​​protected housing and programs of the Andalusian Housing and Land Plan.

Insurance and Guarantees

A financial guarantee and a civil liability insurance policy are required to cover any possible damages arising from the activity.

Overall, this regulatory framework seeks to professionalize the sector, protect consumers and strengthen real estate intermediation in Andalusia.
