Extend the contract “motu propio”
If you are considered a large holder and you rent homes with contracts prior to the Law on the Right to Housing (in force since May 26, 2023), these contracts will continue to be governed by the previous regulations if they are extended. To do this:
1) The extension must be agreed with the tenant, not imposed, and
2) it must be express, thus avoiding the contract entering into “tacit renewal” (this occurs when the tenant remains for more than 15 days after the contract has ended and the landlord has not objected to it).

The option must have a term
In transfers of properties off-plan, granting a right of option allows the buyer to decide whether to acquire the property at the end of the process, without making an initial commitment. It is useful for interested parties who are hesitant and in constructions that are easily sold to others. However, this right must be registered in the Registry; a deed is required that includes the identity of the parties, the property, the price and a maximum term of four years.
