COMMUNITIES OF OWNERS:
It can be prohibited by 3/5
Communities of owners can prohibit the use of homes for tourist purposes by an agreement reached by a majority of 3/5 of the owners and shares. This prohibition is not retroactive, so it only affects those who start the tourist activity after the approval of the agreement. The new owners will be subject to this measure if it appears in the Registry or if they were informed before acquiring the home.
HOUSING LEASES:
There are no extensions here!
The law establishes mandatory and extraordinary extensions in rental contracts.
If the contract is for less than five years (for natural persons) or seven years (for legal persons), it must be extended annually until reaching this minimum. After this period, there is a tacit extension for up to three additional years, unless the landlord or tenant notifies in advance their desire not to renew.
In addition, extraordinary extensions are planned: one for one year if the tenant is vulnerable and the landlord is a large holder, and another for three years if the property is in a Stressed Residential Market area.
To avoid uncertainty, it is advisable to sign contracts of sufficient duration to cover these extensions: at least eight years for individuals and ten years for legal entities.
