Notaries have launched a new portal offering up-to-date and reliable information on actual home purchase and sale prices in Spain.

REAL ESTATE MANAGEMENT EXPENSES AND CONTRACT FORMALIZATION FEES
In the case of leasing a home for habitual and permanent use, as established by the LAU in Section 1 of Article 20 of CHAPTER III, entitled “Rent,” that:
1. “……….Real estate management expenses and contract formalization fees shall be borne by the landlord.”
However, contracts for uses other than residential use are not subject to this mandatory rule, in accordance with the provisions of Article 3 of the LAU, which states:
“1. A lease for a use other than residential use is considered to be a lease that, being for a building, has as its primary purpose a purpose other than that established in the previous article.
2. In particular, leases of urban properties entered into for a seasonal period, whether summer or any other, and those entered into for the exercise of an industrial, commercial, artisanal, professional, recreational, healthcare, cultural, or educational activity on the property, regardless of the person entering into them, will be considered this type of lease.”
The applicable regime, according to Section 3 of Article 4 of the LAU, is:
“Without prejudice to the provisions of Section 1, leases for uses other than residential use are governed by the will of the parties; failing that, by the provisions of Title III of this Law and, additionally, by the provisions of the Civil Code.”
However, the above must be taken into account, with respect to section 2 of article 3, the regulations on short-term leases that came into force on July 1, 2025.
