Fees. An agency managed to collect its fees even though the seller, taking advantage of the verbal agreement, refused to pay, arguing that it would be free of charge. However, all real estate brokerage contracts are presumed to be paid, unless expressly agreed otherwise. The court emphasized that it is well known that these services are usually paid by the seller, with fees generally ranging between 3% and 7% of the sale price. To avoid misunderstandings and protect your rights, always be sure to formalize your orders in writing.
REAL ESTATE SALES:
THIS DEADLINE IS UNFAIR…
In a sales contract for a new-build home, it was agreed that the property would be delivered before a specific date, although the developer reserved the right to extend this deadline on two occasions. However, this clause has been declared void as unfair. As a result, the buyer received compensation for the damages suffered, as he had to continue paying rent for another property for a year.
Therefore, he was compensated with the amount corresponding to those monthly payments.

If you own a rented property and decide to initiate eviction proceedings for non-payment, you can include both the tenant and the joint guarantor in the same claim. Important: This will only be possible if you have previously claimed payment from the guarantor before filing the claim.
