New Decree 31/2024 on housing for tourist use
Decree 31/2024, issued on January 29th, introduces new regulations for tourist homes in Andalusia. Below, we summarize the main developments in five key points:
1.- Identification of the person or company operating it: Now, both before the Administration and before the users, the person or company that offers the service must identify itself. This facilitates complaints and ensures transparency.
2.- A maximum capacity of the home is established:
Complete: Up to 15 places.
Per room: Up to 6 places.
3.- The habitability requirements and demands are updated:
- Minimum area per space: 14 m² built.
- Minimum bathrooms: Between five and eight places: 2 bathrooms. More than eight places: 3 bathrooms.
- Direct ventilation to the outside in living rooms and bedrooms.
- Forced ventilation in kitchens and bathrooms.
- Cooling and heating availability.
- New occupancy schedule: from 3:00 p.m. on the first day until 11:00 a.m. on the day of departure.
4.- Other obligations of the service provider:
- 24-hour telephone service.
- Cleaning between guests.
- Complaint and Claims Sheet.
- Information on rules of coexistence and environmental protection.
- Proof of payments and registration code in the Tourism Registry: the date of entry and exit, the number of people staying, the price of the contracted service, the date of payment and whether the company is a member of the Consumer Arbitration System.
5.- Change of ownership: Those entities that are considered an operating company will have a period of 6 months to notify the Tourism Registry of the change of ownership of the exploitation of the corresponding housing for tourist use.
